Article 2 · Purpose

These General Terms and Conditions of Sale (“GTCS”) are intended to regulate the relationship between Musi’Quiz and the Players, in particular with regard to the provision of a Game Room.

Musi’Quiz and the Players undertake to comply with these contractual provisions, as well as with all local and national laws and regulations, and other instructions issued by the administrative authorities, as well as with the rules laid down by insurers, where applicable.

The Game Rooms are located on Musi’Quiz premises, as indicated on its Website. Musi’Quiz reserves the right, at any time, to modify or have the terms and conditions below modified, as well as the prices and content displayed on its Website.

Musi’Quiz’s General Terms and Conditions of Sale are available in French only, on its Website or upon simple request at the reception desk.

The GTCS are valid as soon as they are posted online.

Article 3 · Pre-contractual information

The Purchaser acknowledges having read the General Terms and Conditions and all the information contained therein, having accepted them prior to the confirmation of any order, and that they are enforceable against them in accordance with Article 1119 of the Civil Code.

Article 4 · Musi’Quiz services

Musi’Quiz offers for sale game room booking services including the use of a musical question-and-answer game with the following features:

Upon request from the Purchaser at the time of booking, they may contact Musi’Quiz to order additional customized services (room booking, buffet, etc.), which will be subject to an additional quotation issued by Musi’Quiz.

Article 5 · Services prices

The price of the services offered for sale on the website is freely set by Musi’Quiz, in compliance with applicable laws and regulations. They are clearly displayed on the website and are available upon request at the reception desk of the game rooms. The price is therefore reduced according to the number of players.

Musi’Quiz reserves the right to modify its prices at any time but undertakes to apply the prices in force indicated at the time of the order.

The price of products and services is not negotiable by the Purchaser. Prices are displayed in euros, including all taxes.

Preferential rates may be offered at certain off-peak times or upon presentation of a student card, as indicated on the website at the time of purchase.

Only credit card payment is accepted on the website. If the person making the booking is unable to pay by this method, an exception may be granted for payment on site by bank card, bank transfer or cash (in euros).

Musi’Quiz has entrusted its payment system to a provider specialized in securing online payments and does not retain any data related to the payment system in its databases.

Payment in part or in full is required at the time of booking.

In the event of cancellation at least 48 hours before the game session by one or more Players for any reason, only a credit note will be offered. This credit note will be valid for 12 months from the date of purchase. After the 48-hour deadline, a credit note will no longer be possible.

No refund may be issued after a game session has been confirmed.

If fewer players than the number planned at the time of booking attend on the booking date, the corresponding price difference will not be refunded.

Musi’Quiz reserves the right to refuse any booking from a person who remains indebted to Musi’Quiz for any amounts invoiced.

For any questions relating to the status of their Order, the Purchaser must contact the Seller directly.

Professional Customers:

A professional Customer will receive a quotation if they request one from Musi’Quiz. An option may be placed to hold a time slot at the Customer’s request. To validate this quotation, the Customer must return the signed quotation. Once signed, a quotation is considered due.

The quotation may be cancelled by the Customer free of charge if the activity takes place at least 30 days after the date of the cancellation request.

A change in the number of players is possible up to 7 days before the service. Once this deadline has passed, the number of players may not be reduced. Additional Players (excluding catering services) may be added up to the day of the event and will be subject to a price adjustment.

The cancellation, absence or lateness of one or more players does not release the Customer from their payment obligation towards Musi’Quiz.

After signing the quotation, the Customer must make payment in accordance with one of the following two payment terms:

- Either before the event: 100% of the quotation amount or, at a minimum, a 50% deposit by bank transfer or payment link, followed by the remaining 50% 7 days after the event.

- Or on the day of the event: 100% of the amount on site by bank card, cheque or cash.

In the event of non-payment, Musi’Quiz may refuse the Customer access on the day of the event.

In the event of late payment, late payment penalties of €40 per reminder and €10 per business day of delay will be charged.

Article 6 · Orders

The order is placed online based on the available booking slots. The Player therefore chooses the date and time of their visit. The Purchaser must then identify themselves by providing their surname, first name, telephone number, postal address and email address.

The Purchaser must confirm their order and make payment for all or part of the booking.

Any confirmation constitutes acceptance of the price and the GTCS.

The Purchaser will then receive a confirmation email from Musi’Quiz within 48 hours. The sale will then be considered final.

In the event of fraudulent use of their bank card, the Purchaser is invited, as soon as they become aware of such use, to contact the Musi’Quiz Customer Service Department and provide evidence of such fraudulent use.

The computerized data stored in the computer systems of Musi’Quiz and its partners under reasonable security conditions shall be considered as evidence of communications, orders and payments made between the parties.
The archiving of orders may be used in the event that proof is requested.

Article 7 · Access to the Rooms

Access to the rooms is reserved for Purchasers who have made a booking online, by telephone or on site.

Players under the age of 16 must be accompanied by an adult.

Players are required to arrive 15 minutes before the game start time indicated at the time of booking. The Customer will be informed of this requirement, at the latest, during the booking process and before payment, as well as in the booking confirmation email. In the event of late arrival, the game session cannot be postponed. The playing time will be reduced so as not to affect subsequent bookings, and the session may under no circumstances extend beyond the scheduled end time indicated when the order was booked.

Game equipment is made available to players subject to fair and careful use, without causing any damage to the equipment. Musi’Quiz reserves the right to refuse access to the Rooms if at least one player is intoxicated or under the influence of illegal substances and displays threatening behaviour towards staff.

Article 8 · Booking changes

The absence of the Players at the date and time indicated will not entitle them to a refund or any other form of compensation.

However, the Purchaser may request to modify their booking free of charge up to 48 hours before the booking date. Any modification must be made by email or telephone directly with the Musi’Quiz centre where the booking was made.

Article 9 · No right of withdrawal

In accordance with the provisions of Article L221-28-12° of the Consumer Code, which provide that the right of withdrawal cannot be exercised for contracts for the provision of leisure activities that must be provided on a specific date or during a specific period, the Purchaser does not have a right of withdrawal.

Article 10 · Gifts

At the end of the Musi’Quiz service, the player declared the winner of the game will receive a “Quiz Master” gift voucher worth the price of one player, valid for a new room booking within 3 months following the issuance of this voucher. This voucher will only be valid for a room booking with a minimum of 4 players.

Only one gift voucher may be used per room booking. This gift voucher will be handed over in person at the end of the game. No duplicate voucher may be issued in the event of loss of the “Quiz Master” gift voucher.

Customers who have booked a “Team Building” offer will receive a prize for the winners of the game session. In addition to the “Quiz Master” gift voucher, the winners will receive one or more Musi’Quiz promotional items (mug, water bottle, bottle opener, pen, for example), subject to availability and at the discretion of the Service Provider.

Article 11 · Gift Cards

Musi’Quiz offers bookings in the form of Gift Cards to be given as gifts. These Gift Cards are represented by a ticket identified by a unique number, and the beneficiary is deemed to be the first holder to present it. A Gift Card is valid for 12 months from the date of purchase. After this period, the card is no longer valid.

Article 12 · Liabilities

Only facts that are directly attributable to Musi’Quiz may give rise to liability on the part of Musi’Quiz towards the Purchaser or the Players, provided that they cause them direct damage.

Musi’Quiz shall not be held liable where the failure to perform or improper performance of its obligations is attributable to:

- Improper use of the Room and its features by the Purchaser or any Player;

- Any fault attributable to the Purchaser or any Player;

- Force majeure, i.e. an unforeseeable and unavoidable event caused by a third party, including: a general strike by public transport drivers followed by more than 50% of the professionals concerned, a technical failure of the game making its use impossible for all Players, an administrative closure of the Musi’Quiz establishment or a pandemic;

- A technical failure of the game that does not make its use impossible for all Players;

- Inconveniences inherent in the use of the Internet network, such as an interruption or disruption of the service, external intrusion or the presence of computer viruses.

In the event that the provision of a Room and the use of the game by all Players prove impossible as a result of a case of force majeure, Musi’Quiz undertakes to postpone, at no additional cost, the performance of the Services ordered before the expiry of a period of three months from the initial date of provision.

The Purchaser guarantees the proper use of the leisure equipment by all Players and guarantees Musi’Quiz against any damage or harm of any kind caused to property, equipment, materials and persons by any Player during the performance of the Services; the Purchaser may in no way invoke the absence of a relationship of subordination or contractual relationship with a Player in order to evade the obligations imposed upon them.

In the event of damage caused by one or more Players linked to the Purchaser’s Order to property or equipment belonging to Musi’Quiz establishments, the repairs will be assessed and notified to the Purchaser within sixty (60) days; the Purchaser shall have a period of fifteen days from the notification issued by Musi’Quiz to pay the cost of the repairs, without prejudice to any recourse to insurance.

In the event of late or non-payment, the Purchaser shall owe a fixed compensation for collection costs in the amount of 40 euros, automatically and without prior notification, in addition to the amount due plus late-payment interest.

During the game, a prize pot and sums of money expressed in a currency, whichever it may be, are mentioned, displayed or announced, and Players may build them up, bank them or lose them over the rounds.

All amounts mentioned in the game are entirely fictitious. They are merely a scoring and staging device, have no monetary value and give no right, during or after the game, to any payment, refund, credit, discount, prize or benefit of any kind, whether to the Players or to the Buyer.

These amounts cannot be exchanged, transferred or converted, and no claim based on their value may be made against Musi’Quiz. The game is neither a game of chance involving money nor a lottery within the meaning of the French Internal Security Code (Code de la sécurité intérieure).

Full or partial payment is required at the time of booking. A deposit equivalent to 4 players may be paid, with the balance payable on site on the day of the game session.
If the booking date is more than 2 days after the payment date, the split-payment option may be chosen. Only one seat is paid at the time of booking, which is then held for 48 hours while the other Players make their payments. If the total paid reaches the full amount requested within that time, the booking is confirmed. Otherwise, the booking is lost and the payments already made are converted into credit notes. Payments received can under no circumstances be refunded.

If one or more Players cancel at least 48 hours before the game session, for any reason, only a credit note will be offered. The credit note is valid for 12 months from the date of purchase. After the 48-hour deadline, no credit note is possible.

Business customers:

A business customer will receive a quote on request from Musi’Quiz. An option may be placed to hold a time slot at the Customer’s request. To confirm the quote, the Customer must return it signed. Once signed, a quote is considered due.

The Customer may cancel the quote free of charge if the activity takes place at least 30 days after the date of the cancellation request. After this deadline, the full amount of the quote remains due.

The number of players may be changed up to 7 days before the event. After that, the number of players cannot be reduced. Players may be added (excluding catering) up to the day of the event, subject to a price adjustment.

The cancellation, absence or late arrival of one or more players does not release the Customer from its payment obligation towards Musi’Quiz.

After signing the quote, the Customer must pay under one of the two following payment terms:

Either before the event: 100% of the quote amount, or at least a 50% deposit by bank transfer or payment link, then 50% 7 days after the event.
Or on the day of the event: 100% of the amount on site by bank card, cheque or cash.

In the event of non-payment, Musi’Quiz may refuse the Customer entry on the day of the event.
In the event of late payment, late-payment penalties of €40 per reminder and €10 per working day of delay will be charged.

Article 7 · Orders

Orders are placed online based on the available booking slots. The player therefore selects the date and time of their visit. The purchaser must then provide their first name, last name, telephone number, postal address, and email address.

The purchaser must confirm their order and proceed with payment of all or part of the booking.

Any confirmation of an order constitutes acceptance of the price and of these Terms and Conditions.

The purchaser will then receive a confirmation email from Musi’Quiz within 48 hours. The sale will then be considered final.

In the event of fraudulent use of their bank card, the Purchaser is invited, as soon as they become aware of such use, to contact the Musi’Quiz Customer Service Department and provide supporting documentation demonstrating the fraudulent use.

Computerized data stored in the IT systems of Musi’Quiz and its partners under reasonable security conditions shall be deemed to constitute evidence of communications, orders, and payments made between the parties.

Orders may be archived and used as evidence in the event that proof is requested.

Article 8 · Access to the Rooms

Access to the rooms is reserved for purchasers who have made a booking online, by telephone, or on site.

The playing time will be reduced so as not to affect subsequent bookings, and the session may under no circumstances extend beyond the scheduled end time indicated when the booking was made.

Game equipment is made available to players subject to fair and careful use, without causing any damage to the equipment. Musi’Quiz reserves the right to refuse access to the rooms if at least one player is intoxicated or under the influence of illegal substances and displays threatening behaviour towards staff.

Article 9 · BOOKING CHANGES

Failure of the players to attend at the date and time specified in the booking shall not entitle them to a refund or any other form of compensation.

However, the purchaser may request to modify their booking free of charge up to 48 hours before the booking date. Any modification request must be made by email or telephone directly to the Musi’Quiz centre where the booking was made.

Article 10 · No right of withdrawal

In accordance with the provisions of Article L221-28-12° of the Consumer Code, which provide that the right of withdrawal cannot be exercised for contracts for the provision of leisure activities that must be provided on a specific date or during a specific period, the Purchaser does not have a right of withdrawal.

Article 11 · Gifts

At the end of the Musi’Quiz session, the player declared the winner of the game will receive a “Quiz Master” gift voucher worth the price of one player, valid for a new room booking within 3 months following the issuance of this voucher.

Article 12 · Gift cards

Musi’Quiz offers bookings in the form of Gift Cards to be given as gifts. These Gift Cards are represented by a ticket identified by a unique number, and the beneficiary is deemed to be the first holder to present it. For this reason, the purchaser of a Gift Card must, under their sole responsibility, ensure that its confidentiality is preserved.

A Gift Card is valid for 12 months from the date of purchase. After this period, the card is no longer valid.

Article 13 · Liabilities

Only facts that are directly attributable to Musi’Quiz may give rise to liability on the part of Musi’Quiz towards the Purchaser or the players, provided that they cause them direct damage.

Musi’Quiz shall not be held liable where the failure to perform or improper performance of its obligations is attributable to:

- Improper use of the Room and its features by the Purchaser or any Player;

- Any fault attributable to the Purchaser or any Player;

- Force majeure, i.e. an unforeseeable and unavoidable event caused by a third party, including: a general strike by public transport drivers followed by more than 50% of the professionals concerned, a technical failure of the game making its use impossible for all Players, an administrative closure of the Musi’Quiz establishment or a pandemic;

- A technical failure of the game that does not make its use impossible for all Players;

Article 17 · Photos, videos and image rights

By agreeing to be photographed or filmed, each Player authorises the Provider, free of charge and without any compensation, to record, reproduce, display, distribute and adapt their image and voice, for a period of five (5) years from the date of capture and worldwide, on any medium and by any means, whether known now or developed in the future, for the purposes of communication, promotion and advertising of Musi’Quiz, its venues, its activities and its partner network. This authorisation covers in particular websites, social media, online advertising campaigns (social media, search engines, display), emails and newsletters, printed materials (posters, flyers, brochures, roll-up banners), billboards, press, promotional videos, trade fairs and sales presentations.

Photos and videos may be cropped, edited, retouched, subtitled or combined with other content (text, music, logos), while respecting the dignity and reputation of the persons shown. Materials distributed during the authorisation period (printed documents already distributed, archived posts) may remain accessible after it ends, with no new distribution.

The person who made the booking undertakes to inform all Players of this clause. For Players who are minors, the accompanying adult declares that they have the consent of the holders of parental authority.

Any Player may refuse to be photographed or filmed by telling the on-site team, or withdraw their authorisation at any time by writing to lille@musiquiz.co. The Provider will then stop any new distribution and remove the relevant content from its digital media within a reasonable time.

The Provider holds the copyright in the photos and videos it produces.

Le Maillon Faible by Musi’Quiz is a game adapted from the TV format “Le Maillon Faible”, operated under licence.

If the total payment reaches the full amount requested within the allotted time, the booking is then confirmed. Otherwise, the booking will be lost and payments already made will give rise to credit notes. Payments received may under no circumstances give rise to a refund.

In the event of cancellation at least 48 hours before the game session by one or more Players for any reason, only a credit note will be offered. This credit note will be valid for 12 months from the date of purchase. After the 48-hour deadline, a credit note will no longer be possible.
